Can I apply for STEM OPT based on a previous STEM degree?
Students can apply based on a prior STEM degree if that degree was earned in the preceding 10 years of the request at a U.S. based educational institution that is accredited; the job the extension is based on must be related to that STEM degree.
How many times am I eligible to be authorized for STEM OPT?
The STEM extension is only available twice per lifetime, regardless of the number of STEM degrees earned.
I am eligible for STEM OPT but I already have a pending H-1B application. Should I still apply for the STEM OPT extension?
Yes, because a pending application is not yet approved and having the STEM OPT authorization would allow you to continue working in case the H-1B application is denied. The only risk in applying is that your H-1B application gets approved and you will not be refunded the $470 dollar USCIS filing fee.
What happens if I miss a reporting deadline?
The missed reporting will be noted on your SEVIS Record. We advise based on regulations for your STEM OPT period but are unsure of the potential consequences of missed reporting. You should still submit your reporting on ISSAlink but note we will be unable to update your SEVIS record since the reporting deadline has passed.
I am changing employers while my STEM OPT application is still pending. What should I do?
You can change employers while your 24-month STEM OPT extension application is pending with USCIS. If you change employers, report the change along with your new I-983 training plan to ISSA through the STEM OPT Reporting Form.
In the “comments” section, explain that your STEM OPT extension application is still pending with USCIS. Regulations state that employment changes must be reported within 10 days.
Can I have multiple employers while on STEM OPT?
Yes, as long as each employer meets all the eligibility requirements. You should submit your STEM OPT Reporting, including an I-983 form for each employer.
